Marintellect shall not be liable for the efficacy of third-party software or hardware products used in provision of service. Liability is limited to additional labor provided by Marintellect, at Marintellect's discretion, to assure client satisfaction with the quality of work provided. We make every effort to arrive on-site promptly and complete off-site work within a scheduled timeframe. However, due to the unpredictable nature of the issues we deal with, Marintellect cannot provide any guarantees as to our timeliness. We will attempt to contact our clients ahead of time to reschedule when necessary, but many of the job sites we work at have limited phone and Internet access, so this is not always feasible. We are very good at what we do, so we are very busy, and scheduling can sometimes be a challenge. Your patience and understanding is appreciated. We go out of our way to help clients with urgent problems, which sometimes means that the less urgent jobs get deferred. There is a delicate balance between labor cost and the thoroughness with which the labor product's efficacy can be verified. Marintellect makes best effort to complete work as thoroughly as possible in the time scheduled and/or billed to the client. It is the client's responsibility to confirm completion of work. Under no circumstance shall Marintellect be liable to retroactively provide additional work free of charge to complete work that would have otherwise been billed up front.
Data loss due to hard drive or other hardware failure is an extremely common problem and can happen to anyone, regardless of environmental factors, frequency or duration of use of the data storage device. It is recommended that clients maintain at least three copies of all irreplaceable data. Marintellect is happy to provide billable assistance with data backup, but shall under no circumstance be responsible any data loss that occurs during the course of work or after subsequent use. It is the client's responsibility to ensure that data is adequately backed up, and to verify that data that is assumed to be backed up can indeed be restored from backup copies.
Malware (including viruses, trojans and other unwanted software) is designed to be elusive and difficult to remove. Marintellect will make best effort to remove malware, but no one can reasonably guarantee complete removal of all malware from an infected system. The most effective method of malware removal is to completely back up all data, erase the computer drive(s) and reinstall everything from scratch. Even with this drastic approach, it is entirely possible, however unlikely, that malware will remain undetected in the data restored from backup. Furthermore, researchers have discovered malware hidden in the embedded code in the computer hardware itself, meaning that it can only be removed by replacing the computer hardware. Marintellect makes best effort to be aware of new potential sources of malware, and uses an ever-evolving, multi-faceted approach to detect and remove these threats, but removal cannot be 100% guaranteed due to the on-going "arms race" between malware and malware removal programs.
